Clutch not fully engaging and 6th gear?

Ok guys, I have renamed mr white pants to "the ugly bike" following a conversation with my 4 year old. So here's the deal with the ugly bike. I've ridden it to work a few times now, remember I got it last fall and it was in fairly rough shape and I only got to ride it a couple times before my shoulder injury. Now I've made my work commute (about 40 miles round trip, with interstate riding) a few times and am having troubles with clutch adjustment and engagement/disengagement (half full/ half empty argument). anyway, with the correct amount of freeplay at the lever, this thing really wants to keep rolling. I can hold it still with a brake on but it bogs down. If I have zero freeplay at the lever it is easier to hold back and I can do so with a firm footing from the paddles God gave me (12 EEEE, and try finding a riding boot for those things). I've read about clutch plates sticking especially after sitting for a while or from getting burnt up or warped.... does this sound like what is happening?

I do have some clunk with changing gears too and then something odd happened on the ride into work today...I found out it has 6 gears! You may be scratching your head at this but I've only been riding in 5 because that's all I could get her to go to, until the ride today. I was thinking, I thought you had six ugly bike and low and behold she went into 6th. On the ride home, she only had 5. I thought it might be a magical day so I tried going into 7th on the way to work but that resulted in what usually happens when trying to find mr 6. (I know this is genderly confusing but, alas, this is the world we live in). Could the clutch sticking cause that or am I looking at a bent/stubborn shift fork? I've had a bent one on my old FJ100 (before the 1340 kit) but that was between 2nd and 3rd, where the action is...the XJ has little action to speak of with that gear change.
