Question on parts purchased on Ebay

Hey guys, I bought a used airbox for the seca and it turned out to be a COMPLETE mess... Despite the mess... which I can clean.
The thing that is getting under my skin is that both seals are screwed up and need to be replaced... What should i do? Is this something I can take up with Ebay or PayPal??
OH.. lets not forget that he left the old filter in it....
